AVSNITT 4 – PRISER OCH FAKTURERING
Priser, rabatter och kampanjer kan ändras utan föregående meddelande. Det pris som debiteras för en produkt eller tjänst är det pris som gäller vid beställningstillfället och anges i din orderbekräftelse. Om inget annat uttryckligen anges inkluderar angivna priser inte skatter, frakt, hantering, tull eller importavgifter.

Priser i våra onlinebutiker kan skilja sig från priser i fysiska butiker eller i onlinebutiker som drivs av tredje parter. Vi kan från tid till annan erbjuda kampanjer på Tjänsterna som påverkar prissättningen och som regleras av separata villkor. Du samtycker till att lämna aktuell, fullständig och korrekt köp-, betalnings- och kontoinformation för alla köp i våra butiker. Du intygar och garanterar att (i) den kreditkortsinformation du lämnar är sann, korrekt och fullständig, (ii) du är behörig att använda kreditkortet för köpet, (iii) avgifter du ådrar dig kommer att godkännas av ditt kreditkortsföretag, och (iv) du betalar avgifter till angivna priser, inklusive frakt- och hanteringsavgifter samt alla tillämpliga skatter.

AVSNITT 5 – FRAKT OCH LEVERANS
Vi ansvarar inte för förseningar i frakt och leverans. Alla leveranstider är uppskattningar och garanteras inte. Vi ansvarar inte för förseningar orsakade av fraktbolag, tullhantering eller händelser utanför vår kontroll. När vi överlämnar produkter till fraktbolaget övergår äganderätten och risken för förlust till dig.

AVSNITT 6 – IMMATERIELLA RÄTTIGHETER
Våra Tjänster, inklusive men inte begränsat till alla varumärken, märken, texter, visningar, bilder, grafik, produktrecensioner, video och ljud, samt design, urval och arrangemang därav, ägs av Woke 'N' Proud, dess närstående bolag eller licensgivare och skyddas av patent-, upphovs- och andra immaterialrättsliga lagar.

Dessa Användarvillkor ger dig rätt att använda Tjänsterna enbart för personligt, icke-kommersiellt bruk. Du får inte reproducera, distribuera, modifiera, skapa härledda verk av, offentligt visa, offentligt framföra, återpublicera, ladda ner, lagra eller överföra något material från Tjänsterna utan vårt skriftliga förhandsgodkännande.

Woke 'N' Prouds namn, logotyper, produkt- och tjänstenamn, design och slogans är varumärken som tillhör Woke 'N' Proud eller dess närstående bolag eller licensgivare. Du får inte använda sådana varumärken utan skriftligt förhandsgodkännande från Woke 'N' Proud. Shopifys namn, logotyp, produkt- och tjänstenamn, design och slogans är varumärken som tillhör Shopify.

AVSNITT 7 – VALFRIA VERKTYG
Du kan ges tillgång till verktyg från tredje parter som en del av Tjänsterna, vilka vi varken övervakar eller har kontroll över. Du bekräftar och godkänner att vi tillhandahåller tillgång till sådana verktyg "i befintligt skick" och "i mån av tillgänglighet" utan några garantier eller villkor av något slag. Vi har inget ansvar för din användning av valfria verktyg från tredje part. All användning av sådana verktyg sker helt på din egen risk.

AVSNITT 8 – TREDJEPARTSLÄNKAR
Tjänsterna kan innehålla material och hyperlänkar till webbplatser som tillhandahålls eller drivs av tredje parter. Vi ansvarar inte för innehållet eller riktigheten på sådana webbplatser. AVSNITT 9 – FÖRHÅLLANDET MED SHOPIFY
Woke 'N' Proud drivs med hjälp av Shopify, vilket möjliggör att vi kan tillhandahålla Tjänsterna till dig. Alla köp och försäljningar i vår butik sker dock direkt med Woke 'N' Proud. Genom att använda Tjänsterna bekräftar du att Shopify inte ansvarar för något avseende transaktioner mellan dig och Woke 'N' Proud, inklusive skador eller förluster till följd av köpta produkter och tjänster. Du friskriver härmed uttryckligen Shopify och dess närstående bolag från alla anspråk, skador och ansvar som uppstår i samband med dina köp och transaktioner med Woke 'N' Proud.

Eftersom Tjänsterna tillhandahålls via Shopify samlar Shopify in och behandlar personlig information om din åtkomst till och användning av Tjänsterna för att tillhandahålla och förbättra dem. Information du lämnar via Tjänsterna kommer att överföras till och delas med Shopify samt tredje parter som kan befinna sig i andra länder än där du bor. Vi kan, men är inte skyldiga att, övervaka, redigera eller ta bort Feedback som vi efter eget gottfinnande bedömer vara olaglig, stötande, hotfull, ärekränkande, pornografisk, obscen eller på annat sätt anstötlig, eller som kränker någons immateriella rättigheter eller dessa Användarvillkor.

Du samtycker till att din Feedback inte kränker någon tredje parts rättigheter och inte innehåller olagligt, kränkande eller obscent innehåll, datavirus eller annan skadlig kod. Du är ensamt ansvarig för din Feedback och dess riktighet.

AVSNITT 12 – FEL, FELAKTIGHETER OCH UTELÄMNANDEN
Det kan förekomma information i Tjänsterna som innehåller typografiska fel, felaktigheter eller utelämnanden avseende produktbeskrivningar, priser, kampanjer, erbjudanden, fraktkostnader, leveranstider och tillgänglighet. Vi förbehåller oss rätten att korrigera fel, felaktigheter eller utelämnanden och att ändra eller uppdatera information eller avbryta beställningar om information är felaktig, när som helst utan föregående meddelande.

AVSNITT 13 – FÖRBJUDEN ANVÄNDNING
Du får endast använda Tjänsterna för lagliga ändamål. Du får inte använda Tjänsterna, direkt eller indirekt: (a) för olagliga eller skadliga ändamål; (b) för att bryta mot lagar eller förordningar; (c) för att kränka immateriella rättigheter; (d) för att trakassera, skada eller förtala anställda eller andra personer; (e) för att sprida falsk eller vilseledande information; (f) för att skicka eller använda material som inte uppfyller dessa Användarvillkor; (g) för att skicka skräppost eller oönskad reklam; (h) för att utge sig för att vara någon annan person eller enhet; eller (i) för att på annat sätt begränsa eller hindra andras användning av Tjänsterna.

Du samtycker dessutom till att inte: (a) ladda upp virus eller skadlig kod; (b) reproducera, sälja eller utnyttja någon del av Tjänsterna; (c) samla in andras personliga information; (d) spamma eller phisha Tjänsterna; (e) använda robotar, spindlar, skrapningsverktyg eller AI-verktyg för att automatiserat komma åt Tjänsterna; eller (f) kringgå säkerhets- eller åtkomstfunktioner. Vi förbehåller oss rätten att stänga av eller avsluta ditt konto om du bryter mot dessa villkor.

AVSNITT 14 – AGENTER
14.1 Detta avsnitt ("Agentvillkor") gäller om du använder, tillåter eller möjliggör att en Agent får tillgång till, använder eller interagerar med Tjänsterna. Med "Agent" avses programvara eller tjänst som agerar autonomt eller semi-autonomt på uppdrag av en person eller enhet, utan direkt tillsyn.

14.2 Ingen Agent får komma åt, använda eller interagera med Tjänsterna om den inte alltid identifierar sig och agerar i strikt enlighet med kraven i avsnitt 14.4 nedan. Ingen Agent får heller komma åt Tjänsterna om vi har begärt att Agenten avstår från detta.

14.3 Vi kan begränsa, inklusive via tekniska åtgärder, om och hur en Agent får tillgång till, använder och interagerar med Tjänsterna.

14.4 Agenter måste: (i) i alla HTTP/HTTPS-förfrågningar identifiera att förfrågan kommer från en Agent och ange Agentens namn i user agent-strängen: "Agent/[agentnamn]"; (ii) inte dölja att åtkomst eller interaktioner sker från en Agent, till exempel genom att efterlikna mänskligt beteende eller kringgå CAPTCHA; (iii) svara sanningsenligt på frågor om huruvida interaktioner kommer från en människa eller dator; (iv) inte kringgå åtgärder avsedda att begränsa eller kontrollera Agenters åtkomst till Tjänsterna.

AVSNITT 15 – UPPSÄGNING
Vi kan säga upp detta avtal eller din åtkomst till Tjänsterna (eller delar därav) efter eget gottfinnande när som helst utan föregående meddelande, och du förblir ansvarig för alla belopp som förfallit till betalning fram till och med uppsägningsdatumet.

Följande avsnitt fortsätter att gälla efter uppsägning: Immateriella rättigheter, Feedback, Uppsägning, Garantifriskrivning, Ansvarsbegränsning, Ersättning, Avskiljbarhet, Avstående, Hela avtalet, Överlåtelse, Tillämplig lag, Integritetspolicy samt andra bestämmelser som till sin natur bör överleva uppsägning.

AVSNITT 16 – GARANTIFRISKRIVNING
Information som presenteras via Tjänsterna tillhandahålls enbart för allmänna informationsändamål. Vi garanterar inte informationens riktighet, fullständighet eller användbarhet. All tillit du sätter till sådan information sker helt på din egen risk. Vi friskriver oss från allt ansvar som uppstår till följd av att du eller någon annan förlitar sig på sådant material.

VI GARANTERAR INTE ATT DIN ANVÄNDNING AV TJÄNSTERNA KOMMER ATT VARA OAVBRUTEN, AKTUELL, SÄKER ELLER FELFRI. AVSNITT 17 – ANSVARSBEGRÄNSNING
I DEN UTSTRÄCKNING SOM LAGEN TILLÅTER SKA WOKE 'N' PROUD, VÅRA PARTNERS, STYRELSELEDAMÖTER, TJÄNSTEMÄN, ANSTÄLLDA, NÄRSTÅENDE BOLAG, AGENTER, ENTREPRENÖRER, TJÄNSTELEVERANTÖRER ELLER LICENSGIVARE, ELLER MOTSVARANDE PARTER HOS SHOPIFY OCH DESS NÄRSTÅENDE BOLAG, INTE VARA ANSVARIGA FÖR NÅGRA SKADOR AV NÅGOT SLAG, INKLUSIVE MEN INTE BEGRÄNSAT TILL UTEBLIVEN VINST, FÖRLORADE INTÄKTER, FÖRLORADE BESPARINGAR, DATAFÖRLUST, ERSÄTTNINGSKOSTNADER ELLER LIKNANDE SKADOR, OAVSETT OM DE GRUNDAR SIG PÅ AVTAL, SKADESTÅND (INKLUSIVE VÅRDSLÖSHET), STRIKT ANSVAR ELLER ANNAT, SOM UPPSTÅR TILL FÖLJD AV DIN ANVÄNDNING AV TJÄNSTERNA ELLER PRODUKTER KÖPTA VIA TJÄNSTERNA.

AVSNITT 18 – ERSÄTTNING
Du samtycker till att hålla Woke 'N' Proud, Shopify och våra närstående bolag, partners, tjänstemän, styrelseledamöter, anställda, agenter, entreprenörer, licensgivare och tjänsteleverantörer skadeslösa från förluster, skador, ansvar eller anspråk, inklusive rimliga advokatarvoden, som uppstår till följd av (1) ditt brott mot dessa Användarvillkor, (2) din överträdelse av lag eller tredje parts rättigheter, eller (3) din åtkomst till och användning av Tjänsterna.

Vi meddelar dig om eventuella ersättningsanspråk. Vi kan kontrollera försvaret och uppgörelsen av sådana anspråk på din bekostnad, men ingår inte uppgörelser som kräver icke-monetära åtaganden från dig utan ditt samtycke. Du ska samarbeta i försvaret av ersättningsanspråk.

AVSNITT 19 – AVSKILJBARHET
Om någon bestämmelse i dessa Användarvillkor bedöms vara olaglig, ogiltig eller ogenomförbar ska den ändå gälla i den utsträckning som tillämplig lag tillåter, och den ogenomförbara delen ska anses avskild från dessa Användarvillkor utan att påverka övriga bestämmelsers giltighet.

AVSNITT 20 – AVSTÅENDE; HELA AVTALET
Att vi underlåter att utöva eller genomdriva någon rättighet eller bestämmelse i dessa Användarvillkor utgör inte ett avstående från sådan rättighet eller bestämmelse.

Dessa Användarvillkor samt eventuella policyer eller driftsregler som vi publicerar på denna webbplats utgör hela avtalet mellan dig och oss och reglerar din användning av Tjänsterna, och ersätter alla tidigare avtal, kommunikationer och förslag mellan dig och oss.

AVSNITT 21 – ÖVERLÅTELSE
